Police in Kenya have been ordered by the country’s chief prosecutor to investigate the deadly dam-burst disaster that occurred on Wednesday killing over 44 people.

The chief prosecutor’s order on Friday is to help establish the circumstances under which the walls of the dam collapsed leading to the flooding of homes, displacing hundreds.

Homes were overrun by the rushing water from the Patel Dam in the town of Solai with many of those killed being residents of the Nakuru County.

There are reports of many people still missing and a possibility that the death toll could increase. 300 families have been displaced by the disaster with over 2000 residents affected.

The dam is one of the three water reservoirs owned by a large-scale irrigation farmer, in the area.

The public prosecutor’s office said on Twitter the police have been asked to “to carry out thorough investigations to establish cause and culpability if any” in the disaster. The police is to report on its investigations within two weeks.

Local media have also reported that villagers complained about the dams when they were built, accusing the farm-owner of not making way for flood water.

But the general manager of the farm, Vinoj Kumar has rather blamed the disaster on heavy rainfall in a forest above the dam.
