Kenya’s High Court has ordered immigration officials to ensure that the opposition politician Miguna Miguna returns to the country after he was deported to Canada this month.
A Kenyan court had ruled revoking the deportation of Miguna Miguna who was flown to Canada by the government.
The court’s ruling appears to have indicted the government’s action which was in response to Miguna’s role in administering an oath for opposition leader Raila Odinga who has declared himself as the country’s “president”.
Miguna Miguna, who is a member of the National Super Alliance (NASA) coalition had welcomed the court ruling in a tweet saying “(We) are fully committed to the rule of law. We shall use the constitution as the spear and the shield in the fight.”
The High Court judge Chacha Mwita on Monday ordered the immigration department to issue Miguna “with a travel document to enable him to re-enter and remain in Kenya pending the determination and hearing of his petition”.
“In default the petitioner shall be at liberty to use his Canadian passport to re-enter and remain in Kenya,” he said.
Miguna was also charged with “taking part in an unlawful assembly” and “engaging in organised criminal activity”. Critics of government condemned the decision to deport Miguna.
The government of Kenya has accused the opposition leader, Raila Odinga of attempting to overthrow a legitimate regime following his inauguration as “people’s president”.
