Kenyans would on Monday know the outcome of the current petition at the country’s Supreme Court challenging the victory of Uhuru Kenyatta in the October 26 presidential re-run poll.
The Supreme Court on Thursday said that a ruling will be given on the case on Monday as the country makes efforts to avoid a constitutional crisis of not having a new President while the current’s tenure expires by the end of this month.
The court made up of six judges has been hearing the oral arguments of lawyers of all parties in the case this week.
Chief Justice David Maraga said after hearing two days of oral arguments that “We want to thank you for your courtesy to each other and the court except for a few remarks here and there and we want to encourage this kind of conduct to be continued.”
This would be the second time the court this year would be giving a ruling on an election petition after nullifying by majority decision the August 8 presidential election also won by incumbent Uhuru Kenyatta.
That ruling attracted mixed reactions from Kenyans with the opposition supporters excited while those from ruling party angry.
A fresh election was ordered to be held within 60 days with the opposition coalition led by Raila Odinga boycotting the re-run poll together with his supporters.
Mr. Odinga has refused to recognize Mr. Kenyatta’s victory on October 26 describing it as a “fraud”.
If the judges on Monday decline the request by the petitioners to annul Kenyatta’s victory on October 26, the incumbent president would then get ready to be sworn in for a second term on November 28.
